Pinson, Clk IMG_9725 Joseph Hatfield was then introduced as a witness for Deft. whos Testified as followeth. I know the Defts. I was a justice of the peace in 1882. Mathew hatfield had charge of the McCoy Boys. I Don’t remember of having seen either one of the Defts. on Blackbary Creek the Day when the McCoy Boys was Taken from the officers. Wall Hatfield said to Randolph McCoy after the Crowd had started Down the Creek with the Prisoners. We understand that we are to be Bush whacked and if we are we will kill the three Boys. Killed along with his brothers Tolbert and Randolph "Randall" McCoy, Jr. also known as "Bud" by the Hatfields in retaliation for the murder of Ellison Hatfield. Ellison was the younger brother of Hatfield patriarch, William Anderson "Devil Anse" Hatfield, a prosperous timberman of West Virginia. At Election Day on August 7, 1882, in Blackberry Creek, Tolbert McCoy got into a heated argument with a Hatfield cousin, Elias Hatfield. Ellison Hatfield got involved and Tolbert wound up stabbing Ellison. Ellison was also shot once and was mortally wounded. The three McCoy brothers were arrested but intercepted by the Hatfields before being taken into Pikeville for trial. Devil Anse claimed he was going to hold the boys prisoner himself in an old schoolhouse on Mate Creek, Logan County, West Virginia and would decide their fate depending upon that of Ellison recovering from his wounds. Devil Anse allowed the boys mother, Sarah McCoy and Tolbert's wife to visit them. Ellison died on August 9th and the boys were taken by the Hatfields across the Tug River into Kentucky. Devil Anse said to them, "Boys, if you have any peace to make with your Maker, you had better make it." He then ordered them to be shot. Randolph McCoy would find his boys bullet riddled bodies, still tied to the bushes, on August 10th. Sarah's testimony at the trial of Cotton Top Hatfield: Tolbert was shot twice in the head, three to four times in the body. Pharmer was shot in the head and ten to eleven times in the body and the top of Bud's head was shot off and was down on his knees hanging on to the bushes. Tolbert had one arm over his face. Tolbert was 21, Pharmer 19 and Randall(Bud) 15 years old. They were hauled home on a sled and buried in one coffin. Pltffs Bill of Exceptions Be it remembered that on the trial of Doc Mayhorn and Plyant Mahon under the above styled prosecution the following proceedings was had. The Commonwealth introduced and has worn as a witness Randolp McCoy, who proves that he is 63 years old that he is the father of Tolbert, Pharmer, and Randolp McCoy, they are now dead, was on Blackberry Creek in Pike County Ky at the August Election 1882 says that the boys in custody about 2 oclock on that day staid on the Election grounds about two hours they then went up to Floyd McCoys and staid until nearly night and then went to John Hatfields house and staid all night. They were in custody of Tolbert Hatfield a Justice of the Peace and Floyd Hatfield special Constable. Defents Doc and Plyant Mayhon are sons in law of Wall Hatfield. My boys was next morning started toward Pikeville in Pike County under a guard of six or seven men and was taken by Wall and Elias Hatfield and then turned back down [page torn] stopped at the mouth of Dial [page torn] his boys was then placed in a large corn sled while there. Anse Hatfield and his squad come up. Defendants was with them when they come up. they had with them country Rifle guns. Dials branch is from a ¼ to ½ miles from where Wall Hatfield came to them. Defendants were there all the time from the time they come to the corn sled. the crowd stopped at old Jerry Hatfield and Charley Carpenter got a rope and tied my three boys together. then went down the creek to Rev. Anderson Hatfields and defendants and all stopped there and got dinner. Knows Ance, Cap & Johnson Hatfield. they was there. Alex Messer was there. After Dinner Devil Ance stepped out and said “all of Hatfields friends form a line” Ance Cap Jonce two Defts. Alex Messer Chuck Murphy was all in the line. Defts had arms (Guns I think). this was Aug 8 1882. My boys was then by this squad marched down the creek toward the river. This is the last time I ever saw them alive. I was on the road from Pikeville home they day my boys was buried. There was quite a crowd at the corn sled. There were a great many persons who were not interested several had guns. If I am not mistaken the first time I saw defendants was at the mouth of Dials branch. I may be mistaken but do not think I am. I saw no one catching horses in pasture at Rev. Anderson Hatfield’s. If I did I do not know who they were. The defts. were present when my boys were tied at Jerry Hatfield’s above Rev. Anderson Hatfield’s. When Devil Ance at the Rev. Anderson Hatfield’s called for the Hatfield friends to fall into the line the defts. went into the line and they were I think both armed with rifles and guns. The boys were then taken down the creek toward Tug river still tied together. I never saw them alive again.

	Floyd Hatfield, cousin of Devil Anse, and Randolph McCoy, had married sisters. In 1873 these two brothers-in-law had a law suit over a sow and some pigs. Rand'l McCoy claimed the hogs but Floyd Hatfield said they were his'n. The son of Randolph McCoy Sr. and his wife, Sarah McCoy. Killed along with his brothers Tolbert and Randolph "Randall" McCoy, Jr. also known as "Bud" by the Hatfields in retaliation for the murder of Ellison Hatfield. Joseph Hatfield was then introduced as a witness for Deft. whos Testified as followeth. I know the Defts. I was a justice of the peace in 1882. Mathew hatfield had charge of the McCoy Boys. I Don’t remember of having seen either one of the Defts. on Blackbary Creek the Day when the McCoy Boys was Taken from the officers. Wall Hatfield said to Randolph McCoy after the Crowd had started Down the Creek with the Prisoners. We understand that we are to be Bush whacked and if we are we will kill the three Boys.

To the above testimony of Jo Hatfield the Deft. objected at the Time and still objects. The Court over ruled the objection. Defts. excepts and still excepts.

Be it remembered that on the trial of Doc Mayhorn and Plyant Mahon under the above styled prosecution the following proceedings was had.

The Commonwealth introduced and has worn as a witness Randolp McCoy, who proves that he is 63 years old that he is the father of Tolbert, Pharmer, and Randolp McCoy, they are now dead, was on Blackberry Creek in Pike County Ky at the August Election 1882 says that the boys in custody about 2 oclock on that day staid on the Election grounds about two hours they then went up to Floyd McCoys and staid until nearly night and then went to John Hatfields house and staid all night. They were in custody of Tolbert Hatfield a Justice of the Peace and Floyd Hatfield special Constable. Defents Doc and Plyant Mayhon are sons in law of Wall Hatfield. My boys was next morning started toward Pikeville in Pike County under a guard of six or seven men and was taken by Wall and Elias Hatfield and then turned back down [page torn] stopped at the mouth of Dial [page torn] his boys was then placed in a large corn sled while there. Anse Hatfield and his squad come up. Defendants was with them when they come up. they had with them country Rifle guns. Dials branch is from a ¼ to ½ miles from where Wall Hatfield came to them. Defendants were there all the time from the time they come to the corn sled. the crowd stopped at old Jerry Hatfield and Charley Carpenter got a rope and tied my three boys together. then went down the creek to Rev. Anderson Hatfields and defendants and all stopped there and got dinner. Knows Ance, Cap & Johnson Hatfield. they was there. Alex Messer was there. After Dinner Devil Ance stepped out and said “all of Hatfields frirends form a line” Ance Cap Jonce two Defts. Alex Messer Chuck Murphy was all in the line. Defts had arms (Guns I think). this was Aug 8 1882. My boys was then by this squad marched down the creek toward the river. This is the last time I ever saw them alive. I was on the road from Pikeville home they day my boys was buried. There was quite a crowd at the corn sled. There were a great many persons who were not interested several had guns. If I am not mistaken the first time I saw defendants was at the mouth of Dials branch. I may be mistaken but do not think I am. I saw no one catching horses in pasture at Rev. Anderson Hatfield’s. If I did I do not know who they were. The defts. were present when my boys were tied at Jerry Hatfield’s above Rev. Anderson Hatfield’s. When Devil Ance at the Rev. Anderson Hatfield’s called for the Hatfield friends to fall into the line the defts. went into the line and they were I think both armed with rifles and guns. The boys were then taken down the creek toward Tug river still tied together. I never saw them alive again.

The Commonwealth then introduced as a witness Dan Whitt who proves that [he] knows the Defts Doc & Plyant Mayhorn. Knew the three McCoy Boys. Saw them on head Blackberry. Ance, Cap, & Jonse Hatfield, C. Carpenter, Alex Messer were there with me. I saw Defts at Rev. Anderson Hatfield’s was there when we came down the creek to that place, do not remember whether they had any arms or not. All the balance of us had arms. Defts. was somewhere above there when we formed line do not remember whether they got in line or not. Do not remember how Defendants crossed the river. Saw them on the West Virginia side. Had no trial at the mouth of Blackberry. Defendants went to the school house on Mate Creek where the McCoy boys were taken. Do not remember that the Defendants had guns or was armed. There was arms there and they was handled through each other. When Aunt Sally come Ance objected to her seeing the boys but consented afterwards. Wall told Aunt Sally that if they were bothered they would shoot the boys as full of holes as a sifter bottom. Myself, Ance Hatfield, Cap, & Jonce Hatfield, Alex Messer, Jo Murphy, Tom Mitchel C. Carpenter Doc & Sam Mayhon Moses Christian and Jeff Whitt crossed over river into Ky with the McCoy boys we crossed in a flat boat we took them up the bank and up the river a piece to a flat place and there surrounded them and set down and some one said something about a shooting match and I told them if that was what they was for I would leave and me and Sam Mayhorn, Jeff Whitt, & Moses Christian run and got 15 or 20 steps away and the guns fired. The boys was tied together. After the shooting the balance all come to where we was on the bank of the river and we all crossed back together in the boat and when we got to the mouth or Just up in the mouth of Mate we found Wall Hatfield, Elias Hatfield, Plyant Mahon, & Elijah Mounts. They was near the sign board. Wall Hatfield there. Saw the crowd that had been near the river to protect each other and never tell anything that had happened that night. I was indicted for this offense and my father in law got a letter from McKenner saying that if I would come in and give up and tell all I knew about the case he would dismiss the indictments against me and I should not be prosecuted. The prosecution has been dismissed against me. I did not take the oath. We left Ance Ferrells in West Va, that is me, Ance, Jonce, & Cap Hatfield, Alex Messer, C. Carpenter, Jo Murphy, Tom Mitchel, Bill Tom Hatfield, & Jeff Whitt with the agreement to go and Hang the McCoy boys. We staid all night at Farmans store at the mouth of Blackberry in Pike Co Ky. We had no agreement with the Mayhon boys to hang the McCoy boys and they knew nothing of the agreement made at Ance Ferrells. I said at the Jail that I would give same amount to know which one of the Mayhon boys was across the river…[cropped]

I know Don and Jeff Whitt. Jeff said at the Jail Door Just after the __ of Wall Hatfield that if he swore Wall, Plyant and Dock Mahorn went across the river where the boys were killed he was mistaken, and that he was served and didn’t know what he was doing and that they were not there.

I staid up at Elias Hatfield’s the night the McCoy boys were killed. I was awoke when Wall and others came there. Dock Mayhorn nor Plyant Mahorn was either of them there. If they were I didn’t see them. I am & have been acquainted with the General Moral character of the Defendants in the neighborhood in which they live and their character for peace is good.

I know Jeff Whitt. I had a conversation with Jeff Whitt the day Wall Hatfield was tried and after he had been sworn as a witness on said trial. In said conversation he said That if he swore on the trial of Wall Hatfield that Dock and Plyant Mayhone was on this side of the river where the McCoy boys were killed. He didn’t know what he was saying. That he was scared and that they were not there.

The killing of Tolbert, Pharmer, and Bud McCoy by a Hatfield-led gang on August 8, 1882 represented one of the most sensational events of the Hatfield-McCoy Feud. What follows is Ellison Mounts’ deposition regarding the affair:

Ellison Mounts
I was present at the time the 3 McCoys were killed. They were killed on the Ky side of the river opposite a little drain, or maybe a little above it. Neither Plyant Mayhorn nor Dock Mayhorn were present at the time or place where the McCoy boys were killed.

Ance, Cap, & Johnce Hatfield, Charley Carpenter, Dan Whitt, Mose Christian and Sam Mayhorn, Jeff Whitt, Alex Messer and myself were present when the killing was done. Jeff Whitt, Dan Whitt, Mose Christian and myself were not ___ present when the Guns were fired. we were 15 or so steps away. After we got across the river Ance called on Wall to Swear them to keep secret what had occurred that nights and Wall did so.

I know Jeff Whitt. I had a conversation with Jeff Whitt the day Wall Hatfield was tried and after he had been sworn as a witness on said trial. In said conversation he said That if he swore on the trial of Wall Hatfield that Dock and Plyant Mayhone was on this side of the river where the McCoy boys were killed. He didn’t know what he was saying. That he was scared and that they were not there.

The killing of Tolbert, Pharmer, and Bud McCoy by a Hatfield-led gang on August 8, 1882 represented one of the most sensational events of the Hatfield-McCoy Feud. What follows is Plyant Mayhorn’s deposition regarding the affair:

The Commonwealth then introduced as a witness James McCoy who proves that he is brother to Tolbert, Randolp (sic) Jr. and Pharmer McCoy. Saw them Aug 9, 1882 on Mate Creek in the state West Va. Saw them on Blackberry Creek on Election day. Jo Hatfield, Mathew Hatfield and Floyd Hatfield had charge off them on that day. First saw them next day at Rev. Anderson Hatfield about 12 o’clock. They were tied arm and arm and all tied together. Saw several persons there. Saw Defendants there. They had guns. I think Rifle guns. Soon after I got there Bad Ance formed a line and said let all Hatfield men or friends fall into line. Deft. fell in to line. Doc had a gun. Am not sure that Plyant had any gun. Ance said when the Prisoners were brought out we will take charge of them now. The whole crowd then went down Blackberry Creek toward the river. Witness went along about 1 ½ miles. Ance said to me I had no business further down and I stopped. Ance further said that he had a notion to tell the officers along that he had no further use for them. I went to Mate Creek in West Va. where my brothers was in a School house Wednesday Aug 9th 1882. I saw Bad Ance, Cap, Jonce Hatfields Defendants Doc & Plyant Mayhorn, Alex Messer, Tom Mitchell and some others. Defendants had guns some times. I left there about 3 o’clock p.m. Went down to mouth Mate Creek, staid a few minutes at Sam Simpkin’s. Then went to Asa McCoy’s at mouth Sulphur. I saw Wall with a papers. Do not know what it contained and heard Wall call for signers. Saw Plyant walk up to Wall but can not say whether he signed it or not. Saw Plyant with Wall & Elias Hatfield and Elijah Mounts that evening late at the mouth Mate Creek. They went up river. Saw them again just after dark pass down by the mouth of Sulphur. I was there and they had not been gone by perhaps 20 minutes when I heard a volley of guns or pistols fired on the Ky side of the river about ½ way between Mouth Sulphur and Mate Creek but on the opposite side of the river from Sulphur. My brothers was dead when I found them. Anderson Ferrell went with him to find them. Found on the Ky shore short distance from river in a sink or flat all tied together and to two Paw Paw Bushes. Tolbert had one hand over his head. Made an examination of my brothers and found Pharmer shot 16 times. Randolph with the whole top of his head shot off. Six or seven shots in Tolbert. We removed them in a sled. They were all burried in one coffin. Elias Hatfield had a gun as they passed me at the mouth of Sulphur, there was one horse in the crowd was considerably excited at times. The officers had the boys in charge for murdering Ellison Hatfield. There were a great many men along who had guns that are not indicted. There was six or seven guards and some that were not guards along with my brothers. I do not know where any one objected to my brothers being brought to Pikevill or not. I can not tell all the parties who had guns. Ellison Hatfield died about 2 ½ or 3 oclock Wednesday Aug 9, 1882. The men who taken the corps of Ellison Hatfield to Elias Hatfields was a part of the men he had seen at the school house. My brothers were found dead in Pike County Ky. Wall Hatfield is the brother of Ance, Elison & Elias Hatfield, and the father in law of the defts. When I saw my brothers at Rev. Anderson Hatfield’s there was also present Ance, Cap, Johns, Wall & Elias Hatfield. Carpenter, Dan Whitt, Messer, Murphy, Mose Christian and defts. When I found my brothers dead they were tied together and to two paw paw bushes. When Wall, Elias, & deft. Plyant Mahorn found me near the mouth of Sulphur at dark they were passing from the direction of Joe Davis’ at mo. Blackberry and going in the direction of the mouth Mate. From Jo Davis’ to mouth of Sulphur is about ½ mile, and from Sulphur to mouth Mate is about ½ mile. From the point where my brothers were found dead in Pike Co Ky is _____ in WVa immediately opposite is about 125 yards. As soon as they passed me near the mouth of Sulphur I ___ my horse pulled some grass and fed him, went back and sat down on the porch, and the firing directly began. I think it was 20 minutes after they passed until the firing began. I think I heard 50 shots. After the volley ceased there was one loud shot.

The Commonwealth then introduced Jas. Hatfield who testified. Am double cousin of defts. father in law. After the line had been formed at Rev. Anderson’s & just after it had started down the creek with the boys I heard Ance Hatfield say to Randal McCoy we understand we are to be bush whacked down the creek and if we are we will kill the boys first. The defts. were then commanded(?) in the line.

Tolbert Hatfield testified that he was one of the Justices that had charge of the McCoy Boys. They were in our custody until about 12 o’clock next day. They were in the crowd that moved to Pikeville with the Prisoners. We were stoped (sic) by Wall. I Don’t remember where I first saw the Defts. Seen them some where between Anderson Hatfield and where we turned back Down Blackbery. One of them had arms. Don’t know which. The McCoy Boys were given up by the authoritys because they could not help themselvs (sic). It is not far from where the McCoy Boys was killed to the road on on the Virginia shore opposite the place where they was killed. Some 200 to 250 yards. The Defs. Were not Present when the McCoy Boys were Turned Back Down Blackbery. Theire were a grate many People theire.

The Commonwealth then introduced as a witness Andy Varney who proves that he knows Defts Wall, Ance, Cap, & Jonce Hatfield, C. Carpenter, Alex Messer. Knows the McCoy boys. I first saw them over on Blackberry just a little above Rev. Anderson Hatfield. Saw Ance, Cap, Jonce, Wall, and Defts. Do not remember seeing defendants with any arms. I next saw them at the river. Was at the school house on Mate creek Tuesday evening to the best of my knowledge the defts had arms there. Guns, I think. The crowd come to Elias Hatfields about 11 oclock. Wall, Elias, Jonce, Ance, Cap, Alex Messer, and the defts they were all armed. They were all there next morning. I was Lying on the porch when the parties came to Elias Hatfield. I saw these two Mayhorn boys there. I staid there all night. I had a gun. I was guarding the prisoners while at school house on Mate. Some one told me he had a summons for a sufficient guard. I have been staying at old man McCoy’s. I was indicted with defendant but the case has been filed away. I was behind all the way down Blackberry Creek with Harrison Steele.

Historical Marker 2047 - Pawpaw Tree Incident is located on KY 1056 near Buskirk, Pike County. It was dedicated on June 7, 2000.

Description
This episode is result of August 1882 election-day fight. Tolbert, a son of Randolph McCoy, exchanged heated words with Ellison Hatfield, which started a fight. Tolbert, Pharmer and Randolph McCoy Jr. stabbed Ellison to death. Later the three brothers were captured by Hatfield clan, tied to pawpaw trees, and shot in retaliation. Presented by Pikeville-Pike County Tourism.
