He was placed as an uncertain son of John Rutherford and Anne (Phillips) based on the usual determinants of time and place, as well as naming patterns and through the process of elimination. Elliott named one of his sons John, which was likely after Elliott's father John Rutherford. Since Elliott was married in Pike Co., KY, he was likely a grandson of Reuben Rutherford, Sr. (1765-1844) [LVNM-LTM] who was the ancestor of the early Rutherford families who settled in Pike Co., KY during the early 1800's. Elliott was likely not the son of Reuben Rutherford, Jr. and Mary (Kezee) because Elliott was not mentioned in Reuben Jr.'s will in 1869 in Pike Co., KY. Elliott was also likely not the son of Reuben, Jr.'s brother James because census records in the early 1800s show James had no sons in his household and only had daughters. Also, James was married to Sarah (Canady) who was likely closely related to Elliott's wife Isabel (Canady), which means Isabel would have also been too closely related to Elliott to get married to him. Elliott was also not likely the son of Reuben Jr.'s brother Robert Rutherford and Jane (Canady) because Jane would have also likely been closely related to Elliott's wife Isabel (Canady). Also, since Robert was born in 1806, he was born too soon to be Elliott's father. Finally, Elliott was also not likely the son of Reuben, Jr.'s brother Joseph Rutherford and Permelia (Kezee) because they were married in 1829, and Elliott was born in 1821 which was many years before they were married. Through the process of elimination, this only leaves Reuben Sr.'s son John Rutherford and Anne (Phillips) as the likely parents of Elliott Rutherford. In addition, according to the 1830 Pike Co., KY census, the household of Elliott's father John included 2 sons who were under the age of 5, which is close enough to be a match for Elliott Rutherford. Eventually though his son Cap Hatfield gunned down Docs son John and grandson Named after him as well. He is listed dying the same year his grandson also named Elliott Rutherford died, I wonder if its a mix up, as I see that a lot. Her maiden name remains unidentified. According to Isabel's marriage record on May 14, 1846 in Pike Co., KY, when she married Elliott Rutherford, it stated Isabel was the daughter of Elizabeth. At the time of the marriage, the law required the permission of a minor's father, which means her father Eli should have given permission, but only her mother Elizabeth gave consent. Since Isabel's parents Eli and Elizabeth were divorced at the time of Isabel's marriage, the clerk was evidently satisfied with Elizabeth's consent for Isabel's marriage. This suggests that at the time of Isabel's marriage, if someone's parents were divorced, either parent was able to sign for the consent of a marriage. Also, it was likely acceptable to receive permission from whichever parent the child lived with after the parents' divorce. The 1840 Logan Co., VA census showed Isabel was living with her mother Elizabeth because her father Eli did not have any females under the age of majority included in his household. However, Isabel's mother Elizabeth was listed as the head of her own household which was separate from her former husband Eli, and Elizabeth's household included a daughter whose age matched with Isabel. Since Isabel was living with her mother and not her father, then the clerk may have been satisfied with the permission of whichever parent Isabel lived with at the time of her marriage which was Isabel's mother Elizabeth. Since Isabel's grandfather Charles Canady (1770-1855) [GWRP-BJ2] was still alive in 1850, if he was her father, he would have given Isabel permission to get married. Since Charles did not give consent for her to get married, it suggests Charles was NOT Isabel's father. Otherwise, according to the law at the time, if Charles was Isabel's father, he would have given Isabel permission to get married. Since there were no other likely paternal candidates in the immediate area, it only left Elias "Eli" Canady as Isabel's father. Also, Isabel was listed as the next-door neighbor to her father Elias "Eli" Canady on the 1860 Logan Co., VA census, as well as her brothers Richard and Samuel. Even though Eli did not sign Isabel's marriage record giving her permission to get married, the close proximity on the 1860 census between Isabel, her brothers and Eli Canady overwhelmingly supports the conclusion that Elias or "Eli" was Isabel's father. Less Last Changed: October 11, 2023 J JoseOnline Andrew Canady Ruled out as Isabel's Father Since Isabel's closest neighbor with the surname Canady on the 1850 Pike Co., KY census was Andrew Jackson Canady and his wife Margaret (Hatfield), who were located only two households away, on the surface, this close proximity suggests it is possible that Isabel was Andrew's daughter. However, Isabel's mother was named Elizabeth, but Andrew's wife was not named Elizabeth because her name was Margaret (Hatfield). Therefore, this appears to rule out Andrew as Isabel's father. Also, Andrew was married to Margaret in 1824, which was before Isabel was born in 1826, and there is no record of any other wife for Andrew. Even though Andrew was not Isabel's father, her father Eli was Andrew's brother, which suggests Andrew was Isabel's uncle.   20240606GHLn- https://www.appalachianhistory.net/2021/02/matewan-shootout-sends-the-hatfields-west.html Matewan Shootout sends the Hatfields west by guest author F. Keith Davis. Davis is a longtime Mountain State newspaperman and former independent book publisher. In town lived another man with an equally fierce reputation, often known as the “bully of Matewan” by locals. His name was John Rutherford, the adult son of Dr. Elliott “Doc” Rutherford. Doc Rutherford had once been a loyal friend of Devil Anse and the Hatfield clan before bad blood arose between them. Anse had, in fact, named his son Elliott after the physician. Johnse Hatfield Johnse Hatfield Family contentions began a couple years before when Doc got into a showdown with John Chafin, a first cousin of Levicy Chafin Hatfield, Devil Anse’s wife and Cap’s mother. In the violent encounter, Chafin received a .38 slug in the spine, which crippled him for life. Strong resentment grew from the incident. There were further hard feelings between John Rutherford and the Hatfields because of the claim by Rutherford that some time prior to the election of 1896 Cap had shot up his house, which Cap denied. According to writings and documentation of Coleman A. Hatfield, historian and Cap’s son, around mid-September of 1896, John Rutherford told a crowd of Democratic volunteers at a saloon in Pike County, across the Tug River from Matewan, that Cap Hatfield, who was one of the few Republicans in the area, was making a stir trying to convert citizens to his political persuasion. “If Cap comes [to Matawan] and votes the Republican ticket,” Rutherford growled, “let’s put him over in Kentucky!”

His name and dates are Wrote on the back of Elliot Rutherford's headstone. Though this is not his father Elliott. They are in the same grave.
