Biography
Born: Daniel Horton was born about 1777 (based upon his appearance on the tax rolls).
Married: Daniel was married first to Mary Fannin and second to Harriet Reynolds who was the Executrix of his Last Will and Testament.
Military Service: On May 24, 1803, "Daniel Horton recommended as Ensign in the 1st battalion, 72nd regiment in place of Thomas Hunt, who resigned."[1] In 1807, Daniel was recommended as an Ensign in Captain William Smith's Company.[2] In 1809, he elevated to the rank of Lieutenant. [2] in 1810, 1812, and 1813, he served as a Constable.[2] By 1813, Daniel had recieved a Commisson from the Governor as Captain of the Second Batallion, 112th Regiment and as a member of the Commissioners of Peace.[2]
Russell County, Virginia Tax Rolls: Daniel first appears on the Russell County (Upper District) personal property tax rolls in 1798.[3] In the 1821 Russell County personal property tax rolls, Daniel was listed as owing 6 enslaved people older than 16 years of age, 15 horses, and one stud horse.[4]
Treasury Warrants:
February 26, 1807 - Daniel Horton - 112 ac - entry dated February 25, 1807 - part of Treasury warrant 1855 dated March 18, 1796 - Russell & Tazewell Counties, the greater part in Russell Co. on both sides of the north fork of Clinch River - old lines of a survey for Samuel Rogers of 87 ac - on the end of a spur by Browns Lick.[5]
Lease:
On March 3, 1813, Daniel Horton leased a tract of land upon which George Kindrick had lived in Russell County, Virginia from Patrick Kindrick for a term of 31 years.[6]
Slave Owner: In 1840, Ensign Daniel Horton was assessed personal property taxes for 1 white male, 9 enslaved people, and 81 horses.[7]
Legal Involvement; Daniel appears frequently as a party and as a juror on the Russell County, Virginia records. For example, in 1805, Daniel Horton was a party to three cases against John Horton all of which resulted in a judgment in favor of Daniel Horton.[8] In 1813, Daniel again sued his uncle John Horton and George Kindrick (also his uncle) in the Tazwell County Chancery Court for breach of warranty of title involving a large tract of land on the Maiden Spring Fork of the Clinch River. The 52 page case file contains depositions of the parties, of Travis Horton (John's son) and others.[9] and [10] Testimony elicited by Daniel Horton from the surveyor included opinions that John Horton engaged in aggressive land entries.
Involvement in the Lewis Horton Murder: Daniel's brother, Lewis Horton, was shot in the back by Abner Vance as he was trying to cross the Clinch River in Virginia. Lewis Horton later died from his wounds. Abner Vance was tried and hanged.
Many commentators assert that Lewis's brother Daniel Horton had eloped with Abner's daughter Betty and returned her two weeks later in disgrace, but this story had been heavily criticized.[11] In fact, the murder more likely arose due to Daniel Horton's harsh business practices and a Chancery suit involving land ownership. This is in line with the 1818 report to the Virginia House of Delegates which recounts that Abner came to Daniel's house to kill Daniel and 3 others, but when Lewis arrived at Daniel's house about the same time as Abner, Abner Vance accused Lewis of giving damaging testimony in a deposition testimony during a Chancery Suit.
Abner Vance was the great-grandfather of Devil Anse Hatfield. The events after Lewis Horton's death are said to have inspired Devil Hatfield hatred of the government and in turn, the McCoys. See the Hatfield and McCoy Family Feud space page
1820 and 1840 U.S. Census: Daniel appears on the 1820 and 1840 US Census in Russell County, Virginia.[12][13]
Death: Daniel died in early August 1843 in Russell County, Virginia.
Last Will and Testament:
I Daniel Horton of Russell County and State of Virginia, do hereby make my last will and testament in manner and form following that is to say. 1st I desire that all the perishable part of my estate be immediately sold after my decease, and out of the monies arising therefrom, all my just debts & funeral expenses be paid, should the perishable part of my property prove insufficient for the above purposes, the I desire that my Executrix, herein after named may rent out a part of my land of which I bequeath to her for her life and afterwards to my daughter Maria Elizabeth, and pay what may be unpaid together with what may be found to be due me from other people.
2dly After the payment of my debts and funeral expenses I give to my wife Harriet Horton all my estate both real & personal debts of to be enjoyed by her during her natural life at at her death that it descend and go to my said daughter Maria Elizabeth Horton to be enjoyed by her and her heirs and assigns forever and I further declare that I have already given to all of my other children all that I ever intend to give to them and that as I did give to my daughter Sally George & her husband Hervey George the land whereon I now live by deed and had the same recorded it is hereby ratified and confirmed by me, and further I did by Article of agreement, give to the said George my land on the north side of the Maiden Springs fork of Clinch River but it was on consideration that he would come on the plantation where I now live & occupy it with me and as he has failed in it & he has not paid me anything for the s'd land or done anything to entitle him to it I do hereby revoke the said Article of agreement, and give the said land to my said daughter Maria Elizabeth Horton her heirs and assigns forever. And as it is reported that I have already conveyed the s'd land to Hervey George by deed in Tazewell County which I deny and I hope he will not offer to contend for it - as I know it would be unjust for him to offer to take it from my destitute & unprotected infant daughter.
And lastly I do hereby constitute and appoint my very worthy wife Harriet Horton sole Executrix of this my last will and Testament hereby revoking all other or former wills or testaments by me heretofore made I further state that I owe Harry Smith considerably by bonds & account and I did give him certain property and a bill of sale of the same with an additional inventory of which he promised me I should have back on my paying him. I wish my Executrix herein before appointed to pay him & have the property as her own. In witness whereof I have hereunto set my hand and affixed my seal this seventeenth day of October in the year one thousand eight hundred and thirty two.

On motion of John T. Smith who made oath, and together with Robert Boyd his security entered into and acknowledged a bond in the penalty of $500,00. conditioned as the law directs certificate is granted him for obtaining the administration of the estate of Daniel Horton deceased with his will heretofore proved in this Court annexed in due form.
