There is confusion on if his middle name is Eberle or Elliott.
John and his nephew Elliott, who are buried in the same grave, were gunned down by Devil Anse Hatfield's son Cap and his step son Joe Glenn on election day in 1896.
His name and dates are Wrote on the back of Elliot Rutherford's headstone. Though this is not his father Elliott. They are in the same grave.
